David Carruthers of BETonSPORTS may benefit from WTO RulingBETonSPORTS CEO David Carruthers appears to have a little luck on his side these days. Judge Mary Ann Medler of the United States District Court, Eastern District of Missouri, ruled that World Trade Organization’s recent panel ruling in favor of Antigua can be introduced as grounds for dismissal of the indictment's against Carruthers.

The ruling was issued SUA SPONTE, which in Latin means “of one’s own accord,” is a legal term that means to act spontaneously without prompting from another party. Attorneys for Carruthers have until May 2nd, 2007 to file their motions. The US Government has until May 9 to file and any reply will be filed no later than May 16th, 2007.

In order to prove their case against the BETonSPORTS defendants, Federal prosecutors must demonstrate that taking bets from US citizens is illegal. This is going to be a tougher task now that the WTO decision calls the American stance against internet gambling illegal under international laws.

The World Trade Organization released the official 215 page report on March 30th, 2007 declaring that the United States violated the WTO GATS Treaty by failing to change legislation that unfairly targets foreign online gambling websites. The ruling was a major victory for the tiny Caribbean island of Antigua & Barbuda as well as the rest of the online gambling industry.

BETonSPORTS plc officials were indicted in July 2006 by a federal grand jury on various charges of racketeering, conspiracy and fraud. The indictment was unsealed back in July 2006 when the FBI picked up UK citizen David Carruthers while he was on a layover between the UK and Costa Rica in the Dallas/Fort Worth Airport. Carruthers is currently under house arrest in a St. Louis hotel awaiting trial.
